1. Terms and conditions for Simmer Style

1.1 These terms and conditions (the ”Terms and Conditions”) apply when you as an individual make a purchase from www.simmerstyle.com (the “Website”). When you make a purchase on the Website, an agreement is entered into between you as an individual and Simmer Style AB, with organization number 556229-8520 and address c/o Tomas Persson, Glasbruksvägen 15, 305 72 Steninge, Sweden (”Simmer Style”, ”us” or ”we”).

2. Agreement and order

2.1 We do not sell to companies – only customers who act as private individuals (consumers). When you make a purchase on the Website, you will accept these Terms and Conditions, which apply to all our sales.

2.2 When you have completed your purchase, you will receive a receipt to the email address provided in connection with the purchase. This receipt is a confirmation of your purchase and is proof of a binding agreement.

3. Age limit

3.1 Simmer Style has the right to deny purchases by a customer that does not, according to applicable mandatory law in the customer’s country of residence, have the right to enter into agreements regarding purchase of the products sold by us, e.g. normally under 18 years old and/or not under guardianship. By purchasing a product at the Website you confirm that you possess the legal right and ability to enter into a binding agreement with Simmer Style.

4. Price and payment

4.1 When ordering, the prices that are stated on the Website at the time of ordering apply. All prices are represented including applicable VAT but excluding customs duty. [2] The prices do not include any payment fees or shipping fees, which are presented separately. [2] 

4.2 Where a pricing error is obvious and unmistakeable and could reasonably have been recognised by you as a mispricing, the price or information will not apply to the purchase. Where that is the case, we will contact you as soon as possible.

4.3 When ordering from simmerstyle.com, you are responsible for ensuring the product can be lawfully imported to your country. Prices are shown included taxes on the website, for countries outside of the EU taxes are deducted in the cart. Depending on your country of residence Simmer Style reserves the right to contact you for further information, if needed.

Recipients of international shipments may be subject to import taxes, fees, and customs duties (hereafter, “Import Fees”), levied by the customs office of your shipping destination. Import Fees vary according to the customs regulations of the destination country. 

Components that play a role in Import Fee calculations are (among others):

  • Product category and price
  • Shipping costs and package weight
  • Customs clearance channel
  • Import taxes based on custom duty amounts

 

Customs policies vary widely, and some countries don’t charge Import Fees for shipments that fall below a minimum value. Contact the customs office of the destination country for more information. 

5. Payment options

5.1 We offer different payment methods for you to choose from. The available payment methods are always stated in the checkout. Additional costs may apply, depending on the method of your choice. 6. Shipping and delivery

6.1 Products are delivered to you with the delivery method you choose at the checkout. You will find information about your options on the Website and at the checkout. We offer free shipping with some delivery methods providing your purchase exceeds a certain amount. We will inform you about this on the Website.

6.3 We do not deliver to USA, Canada, Japan, Russia and Belarus.

7. Estimated delivery time

7.1 The estimated delivery time is stated on the Website and in the order confirmation and may differ depending on the chosen delivery method. The estimated delivery time stated on the Website is calculated from the order confirmation. We always strive to deliver your order within the estimated number of working days stated on the Website and on your order confirmation.

7.2 If we are unable to deliver the order within the promised delivery time, a new time will be offered. The customer can either accept the new time or cancel the order and receive a full refund.

8. Right of withdrawal and open return

8.1 According to EU consumer protection legislation, you have the right to cancel your purchase within 14 days from the day you, or a person on your behalf, receive the product that you have purchased on the Website.

8.2 When you exercise your legal right of withdrawal of 14 days, you have the right to open the package and examine the product to the extent required in order to assess its character, quality and function. In these cases, you have the right to a full refund of the product price if you notify us within 14 days from the day you received the product. If you handle the product to a greater extent than required to assess its character, quality and function, we have the right to reduce the refund according to the decrease in value. Read more about what it means below in section 9.1.

8.3 In addition to the right to withdrawal, we give you another 16 days (a total of 30 days) of open returns. Please note that you must pay for return shipping. However, we only offer this extended return terms for products that are completely unused. See section 8.4 for more details.

8.4 If you wish to exercise the right to open returns after the statutory 14-day right of withdrawal has expired, you may do so for up to 30 days after delivery of the product, provided that the product is unused, in its original condition, all labels attached and in its original packaging. Original packaging only refers to products with a cardboard box, e.g. sails, boards and hardware.

The right of withdrawal and open returns do not apply for certain products

8.5 For certain products, neither the right of withdrawal nor open return apply. If a product is not suitable for return due to health and hygiene reasons, you will not be able to return the product if you have broken the seal on the product. Also, you do not have the possibility to return a product that has been manufactured according to your instructions or that otherwise been given a clear personal touch. If the right of withdrawal or right to return does not apply, it will be stated in connection with the product.

How to return

8.6 You can use your right of withdrawal

or open returns in several different ways. For easy handling and faster refunds, we recommend that you register your return [email protected] and follow the instructions on how to send the product back to us. You can always contact us thru the email address stated in section 1.2 of these Terms and Conditions or use our form for exercising the right of withdrawal which you can find on the last page of these Terms and Conditions[3] . 8.7 After you have notified us that you want to make a return, you need to send the product back to us within 14 days. We recommend that you return the product in the same package you received it in, since you are responsible for any damage or loss during the return shipping caused due to your negligence, for example when choosing a carrier or when addressing or packaging the product.

Costs of return shipping

8.8 When making a return you pay for the cost of the return shipping. If you choose the return shipping we offer, stated in section 8.6, the cost is depending on your country of residence and that cost will be deducted from your refund.

9. Your refund when using your right to withdrawal or open returns

9.1 If you use your right of withdrawal within 14 days, we have the right to deduct an amount equal to the products value reduction if you have used the product more than necessary to determine its character, quality and function. Such a deduction is made according to the product’s value upon return compared to the original value at the time of purchase. If you want to return a purchase after the 14-days legal right of withdrawal has passed, you are entitled to a refund for up to 30 days from the time you received the product with our right to open returns provided that the product is unused, in its original condition, all labels attached and in its original packaging.

9.2 When you use your right of withdrawal within 14 days, we will process your refund within 14 days from the day you notified us of your wish to cancel your purchase or announced that you wish to use your right to return. However, we will not issue the refund until we have received the returned product or before you have shown that you have sent it to us. Refunds will be issued to your original method of payment, unless otherwise agreed. Note that depending on the payment method you chose at the time of purchase, it may take a few extra days for us to process the refund.

9.3 When you use your extended right to open returns after the first 14 days, we will await the returned product and inspect it before we make your refund. We only accept your return and issue your refund if the product is unused, in its original condition, all labels attached and in its original packaging.

10. Complaints

10.1 If there is something wrong with your product, you have the right to make a complaint about the faulty product in accordance with mandatory consumer protection legislation that applies in the country where you have your usual place of residence. You have a right to make a complaint within two years after the day you received the product, or such longer period a customer may have right to according to mandatory applicable consumer protection law in the country where the customer resides. You always need to make your complaint within a reasonable time after you should’ve detected any defect. Your right to complain expires no later than two months after the three-year period has passed.

10.2 To make your complaint, we recommend that you register your complaint here[4]  or by contacting us by the email address stated in section 1.2 of these Terms and Conditions. Our customer service will then help you further with your complaint. Our address to make complaints is [email protected]. If you want to complain about a product, please contact us as soon as possible after you have discovered the defect.

10.3 When the product in question has been received and it has been established that the complaint is justified, we will reimburse you in accordance with applicable law.

11. Defect product or delayed delivery

11.1 If there is any defect in your product or if the delivery is delayed, we are responsible for the damage you suffered as a result of the defect or delay in accordance with applicable mandatory consumer protection legislation. However, we are only liable for damages to the extent that you have taken reasonable steps to limit your damage. We are therefore not responsible for damages that you could have avoided by taking reasonable steps to mitigate your losses. If your package arrives damaged you need to contact us within 12 hours after the delivery at [email protected]. If possible inform the courrier about the damaged goods delivered. Simmer Style needs to process the claim within 24 h. 

12. Uncollected packages

12. 1 You are responsible for receiving or collecting your package in accordance with the instructions you receive in connection with your order. Packages that are not collected within the time specified on the advice note will be sent back to our warehouse. We have the right to charge a fee of 2000 SEK[5]  which corresponds to our costs for shipping in cases where you do not collect your package. If you notify us that you want to withdraw your purchase before the package is automatically returned, we will not charge the fee for uncollected packages.

14. About these Terms and Conditions

14.1 We have the right to change these Terms and Conditions, but the Terms and Conditions that you agreed to at the time of your purchase will always apply to that purchase. All changes will be stated in the latest published version of the Terms and Conditions on the Website. Changes will be effective from the time you have accepted the Terms and Conditions, i.e. in connection with you making a new purchase on the Website.

14.2 These Terms and Conditions shall be interpreted and applied in accordance with Swedish law. If any provisions of these Terms and Conditions would be considered invalid or unenforceable by any competent court, authority or alternative dispute resolution body, the other parts of that provision and all other provisions of these Terms and Conditions will remain valid and fully enforceable in accordance with applicable law.

14.3 We are a Swedish company with our head office in Sweden and are therefore covered by both Swedish and European law. However, you always have the right to exercise the rights available for consumers in the country where you have your usual place of residence. This means that we will always comply with mandatory consumer protection legislation that are in force in your country. We have no intention of excluding or restricting such rights through these Terms and Conditions.

16. Governing law and disputes

16.1 In cases of any dispute with a customer, you may lodge a complaint to the Swedish National Board for Consumer Disputes or any corresponding alternative dispute resolutions where the customer has its country of residence. The Swedish National Board for Consumer Disputes may be accessed either via the website www.arn.se or address Box 174, 101 23 Stockholm. To access the alternative dispute resolution in your country, please click here. A customer may also lodge a complaint at the European Commission’s platform for online dispute resolution (the “ODR platform”) which you may access here: http://ec.europa.eu/consumers/odr/.

16.2 Any dispute regarding the interpretation or application of these Terms and Conditions shall be governed by and construed in accordance with Swedish law and, except as provided in section 17.1, settled by public court. Swedish law shall not however apply in a situation where a customer has better rights according to mandatory applicable consumer protection law in the country where the customer resides.

16.3 Notwithstanding the foregoing, we may take any legal action necessary at any competent court in the customer’s country of residence for collection of delayed payments. The parties do hereby accept that the jurisdiction of such court shall apply for such purpose.

17. Force majeure

17.1 We are not liable for damages caused by unforeseen circumstances beyond our control, for example wars, natural disasters or pandemics – as declared by the WHO, which we could not reasonably have foreseen (Force Majeure). However, you always have the right to cancel the purchase in accordance with mandatory consumer protection legislation.
